Order, delivery, return, exchange agreement and terms of use.

Basic concepts
Buyer Agreement – ​​all the terms and conditions set out below in this document regarding online purchases; BUYER – an individual or legal entity who orders/purchases goods and services listed on the portal through the technical capabilities provided by the shoppingaz.az online platform and makes an electronic payment, and also agrees to the terms and conditions of this “Return and Exchange Agreement”; SELLER – an individual or legal entity who sells their goods/services online on their own shoppingaz.az portal and determines the terms of sale and delivery themselves; PORTAL – an online shopping venue for goods and services, owned by ShoppingAZ LLC, “www.shoppingaz.az” website; GOODS/SERVICES – any goods, services, supplies, materials, items and other materials and goods placed on the PORTAL (including their installation or any part thereof); ORDER – filling out the relevant form available on the Portal and sending it electronically to the SELLER in order to purchase goods/services from the Portal for delivery to the address specified by the Buyer. RETURN – The BUYER’s return of the GOODS/SERVICES purchased from the PORTAL to the SELLER and receiving the amount paid. EXCHANGE – The BUYER’s return of the GOODS/SERVICES purchased from the PORTAL to the SELLER and receiving other GOODS/SERVICES in exchange.
Special conditions
  1. The subject of the agreement is to provide the BUYER with the opportunity to purchase, return, change and use the goods/services presented on the PORTAL for personal and other purposes. The terms of this Agreement apply to all goods and services currently sold on the PORTAL.
  2. The conditions for the return and exchange of goods/services sold on the PORTAL are regulated by Article 15 of the current Law of the Republic of Azerbaijan “On Protection of Consumer Rights”.
  3. The BUYER, ordering goods on the PORTAL, declares that he fully agrees with the terms of this AGREEMENT.
  4. SELLER may change the terms of purchase without prior notice prior to completion of purchase.
  5. The purchase is considered complete after the BUYER pays for the product/service in any form (online/cash) using a sales receipt or other document confirming the purchase.
  6. By filling out the order form on the PORTAL, the BUYER does not object to the SELLER using his contact information. This includes sending the BUYER various discount companies and other related information in the future.
  7. By placing an order, the BUYER does not object to the SELLER transferring the performance of its obligations to third parties, and the SELLER is responsible for the actions of third parties in relation to the order that deviate from this AGREEMENT.
  8. The BUYER may use the services of the PORTAL at any time of the day, month, year, except for days of technical and preventive maintenance on the page "www.shoppingaz.az", as well as cases of force majeure. If the BUYER suffers damage due to the suspension of the PORTAL's activities for any period of time due to reasons beyond the control of the PORTAL, as well as the inability of the SELLER to fulfill its obligations arising from this Agreement, in this case the SELLER shall not bear any liability.
  9. Images of products sold on the PORTAL are illustrative in nature and may not be 100% identical to the purchased products. In case of significant lack of information, the BUYER may send a written request to the PORTAL.
  10. If the ordered product is not in the SELLER's warehouse, despite being displayed on the PORTAL, the SELLER will cancel the order by notifying the BUYER as soon as possible. The SELLER will not be liable for any actual damage suffered by the BUYER as a result of the order cancellation.
  11. After placing the order, depending on the distance of the BUYER's address, the SELLER informs the BUYER of the date, time of delivery and other conditions of the order.
  12. Exchange and return are carried out only in the presence of the person specified in the documents, and only in the SHOPPINGAZ chain of stores. Exchange and return are not included in the cost of the courier service.
  13. Regarding the order, return, exchange, delivery or other problems, the BUYER can submit complaints electronically to the SELLER's email address [email protected].
  14. All disputes or claims arising out of or relating to this Agreement, including its interpretation, execution, termination or invalidity, shall be resolved primarily through good faith and friendly negotiations between the parties. If such dispute is not resolved between the Parties within 5 working days, the dispute shall be resolved by the relevant courts of the Republic of Azerbaijan.
Delivery rules
  • In the regions where our stores are present, the delivery service is FREE for goods priced from 100 AZN (and above) in online installments or when ordering in cash.
  • We deliver throughout the country.
  • Delivered goods may only be presented to the buyer who made the purchase online. Under no circumstances may the goods be given as a gift to another person.
  • When ordering some products online, a photo may be taken at the time of delivery to verify the identity of the ID holder.
  • Upon delivery of the order, the client must sign the contract, present the original ID to the courier and give him a copy of the ID.
  • The delivery service is carried out by the coordination department and operates according to general rules.
